Counterfeit medical devices are offered to be withdrawn faster

Owners of counterfeit, substandard or counterfeit medical devices may be required to bear the costs of removing them from circulation. The State Duma plans to consider the corresponding bill at the plenary sessions of the spring session.

According to the current legislation, violators are obliged to pay only for their destruction.

“The document was prepared by the Ministry of Health in pursuance of the president’s instructions and is aimed at prompt seizure of counterfeit, substandard, falsified medical products, including from healthcare institutions, at the expense of violators,” Alla Samoilova, head of Roszdravnadzor, said at a meeting of the State Duma Committee on Health Protection on March 24.

Roszdravnadzor can obtain the right to make decisions on the seizure of low-quality medical devices and their disposal, and the service will also be able to go to court with claims for the enforcement of such decisions. Today, only the courts make decisions on the withdrawal from circulation and destruction of counterfeit medical products.

“The implementation of the bill will allow participants in the circulation of medical devices to minimize financial risks associated with the identification of medical devices in circulation in violation of the law,” – stated in the explanatory note to the document.
